Regulations of the online store

  1. General provisions
    1. These regulations define the terms and conditions for placing and implementing orders related to the sale of products via the Laura Guidi sp. zoo Sp. komandytowa, conditions and method of withdrawal by the parties from the execution of the order and the complaint procedure.
    2. The Regulations are the regulations for the provision of electronic services within the meaning of art. 8 of the Act of 18 July 2002 on the provision of electronic services in the field of order fulfillment services related to the sale of products via the online store Laura Guidi sp. zoo Sp. komandytowa, .
    3. Online store Laura Guidi sp. zoo Sp. komandytowa, is run by Laura Guidi sp. zoo Sp. komandytowa, z o. o. with its registered office in Grodzisk Mazowiecki.

  2. Reading the Regulations before using the Laura Guidi sp. zoo Sp. komandytowa, is the obligation of persons using the online store Laura Guidi sp. zoo Sp. komandytowa, .
  1. The terms used in the Regulations mean:
    • Shop/Online shop Laura Guidi sp. zoo Sp. limited partnership, – online store run by Laura Guidi sp. zoo Sp. komandytowa, z o. o. available at e.lauraguidi.pl, through which the User can place an Order;
    • Seller – Laura Guidi sp. zoo Sp. komandytowa, z o. o. with its registered office in Grodzisk Mazowiecki, running the online store Laura Guidi sp. zoo Sp. limited partnership, ;
    • Laura Guidi sp. zoo Sp. limited partnership, – Laura Guidi sp. zoo Sp. komandytowa, z o. o. with its registered office in Grodzisk Mazowiecki, ul. Sienkiewicza 45, 05-825 Grodzisk Mazowiecki, NIP 529-166-40-60, REGON 015331426, registered under KRS number 0000148763 by the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register; share capital: PLN 50,000.00;
    • Order– declaration of will of the User (Client), aiming directly at the conclusion of the Product Sales Agreement via the Store, specifying the type and number and other features of the Product, including the Order without Registration,
    • Order without Registration– User's declaration of intent, aiming directly at concluding a Product Sales Agreement via the Store, specifying the type and number and other features of the Product without Registration, submitted using the "Order without Registration" form on the Store's website;
    • Basket– an element of the Store, where the Customer indicates the details of the Order, such as: delivery address, invoice details, delivery method, payment method and other data, if their disclosure is necessary for the execution of the Order;
    • Sales agreement– a sales contract within the meaning of the provisions of the Civil Code, concluded between the Seller and the User (Client) using the Laura Guidi sp. zoo Sp. limited partnership, ;
    • Services– services related to the acceptance and execution of Orders for Products presented in the Store;
    • Product– an article available for ordering in the online store Laura Guidi sp. zoo Sp. limited partnership, ;
    • User– a natural person, legal person or organizational unit without legal personality that uses the Store in any way, e.g. by registering, placing Orders or Orders without Registration or otherwise;
    • Client– a User who concluded a Sales Agreement via the Store (both Consumer and Entrepreneur);
    • Consumer– a natural person performing a legal act not directly related to its business or professional activity within the meaning of art. 22¹ of the Civil Code;
    • Entrepreneur – a natural person, legal person or organizational unit referred to in art. 33¹ § 1 of the Civil Code, performing activities in connection with their business or professional activity;
    • Account– a subpage of the Store website, run for a registered User under a unique User name (Login), under which the User can, among others, managing personal data and managing the status of Orders placed by him; using the Account requires Registration and each time providing the Login and Password;
    • Registration – a free procedure for setting up an Account in the Store, including the selection of a Login, Password, providing personal data necessary to use the Store's Services and accepting the Regulations;
    • Login– unique name of the User, enabling his identification in the Store, selected by the User during Registration;
    • Password– a unique series of characters (numbers, special characters and/or letters) selected by the Customer during Registration, used to log in to the Store in order to confirm the Customer's identity;
    • Supplier - the entity responsible for the delivery of the Products covered by the Order, selected by the User in the Order;
    • newsletter– commercial information regarding the Seller, including in particular current promotions, new Products and loyalty programs.
    • Statute– these regulations;
    • Civil Code – Act of 23 April 1964 – Civil Code (Journal of Laws of 1964 No. 16, item 93, as amended)
    • Act on the protection of certain consumer rights andon liability for damage caused by a dangerous product -Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (consolidated text, Journal of Laws of 2012, item 1225, as amended);
    • Act on special conditions of consumer sales and amending the Civil Code - Act of July 27, 2002 on special terms of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended);
    • Act on the provision of electronic services– the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item 1204, as amended);
    • Personally Identifiable Information Protection Act– Act of 29 August 1997 on the protection of personal data (consolidated text, Journal of Laws of 2002, No. 101, item 926, as amended).
  2. Using the Store and the rights and obligations of the User
    1. Using the Store is possible after prior User Registration by completing the registration form on the Store's website. A User interested in placing an Order without Registration may place an Order without the Registration process by selecting the order option "Place an order without creating an account" and completing the form available after selecting this option. Placing an Order without Registration does not allow you to track the history of Orders or preview the Order and each purchase in the Store requires re-entering certain data.
    2. Registration, placing an Order or Order without Registration require acceptance of the Regulations. Logging in to the Store, placing an Order or Order without Registration means acceptance of the Regulations in their current wording. The Regulations are made available to Users free of charge via the Store, in a way that allows them to be downloaded, recorded and printed.
    3. By registering or placing an Order without Registration, the User consents to the processing of his personal data by the Personal Data Administrator Laura Guidi sp. zoo Sp. komandytowa, z o. o., including in particular the name, surname, telephone number and full address, in accordance with the Privacy Policy of the Laura Guidi sp. zoo Sp. komandytowa, . By expressing consent, the User also declares that he/she acknowledges that providing data is voluntary, although the refusal to provide them is tantamount to the inability to place Orders in the Store.
    4. The user may consent to the processing of his personal data for marketing purposes. This consent may be withdrawn at any time on the basis of a written statement delivered to the Seller.
    5. In order to protect personal data, Users undertake to keep their Login and Password confidential. It is forbidden to use the User Account by third parties.
    6. Correct and full use of the Store by Users requires viewing it in the following browsers: Microsoft Internet Explorer 8 or a newer version, Mozilla Firefox 3.5 or a newer version, Google Chrome 6 or a newer version and Safari 5 or a newer version. The Seller is not obliged to provide customers with the devices necessary to place an Order in the Store.
    7. In order to ensure the safety of Users in connection with the use of the Store, the Seller takes appropriate technical and organizational measures. Due to the fact that there is no security guaranteeing full protection of information and websites on the Internet, the User should comply with all security measures, including in particular appropriate anti-virus protection and confidentiality of data used to log in to the Store.
    8. Completing the Registration means the User's consent to log in to the User Account of persons authorized by the Seller, for the purpose of proper maintenance of the Account (in particular to provide assistance to the User) and to receive messages generated by the Store, necessary for using the account and executing Orders.
    9. Store users are prohibited from entering and providing content that is contrary to the law.
  3. Terms and procedure for placing Orders
    1. The User may place Orders in the Store 24 hours a day, all days of the year. An order is possible after logging in to a previously created Account or by placing an Order without Registration. By placing an Order (including Orders without Registration), the User submits an offer to conclude a Sales Agreement for the ordered Products with the Store.
    2. The order is made by selecting one or more Products posted on the Store's website by indicating their names, color, size, or other characteristics of the Product and quantity, and then by adding them to the Basket.
    3. When placing an Order, the User also indicates the method and address of delivery, e-mail address, accounting document confirming the sale, which he wants to receive and the method of payment. The payment methods and their costs are indicated on the Store's website. An order without indicating the above data will not be considered as submitted. Initial verification of the Order will be made by e-mail sent to the e-mail address provided by the User.
    4. In the case of placing an Order without Registration, the User, in addition to the data specified in points 4.2. and 4.3. above is obliged to provide each time additional data enabling its identification and data specifying the method of contact in the form of e.g. name, email address, postal address and contact telephone number. Without providing all the data covered by the order option form "Place an order without creating an account", it will not be possible to complete the Order and the Order will not be considered as placed.
    5. Photos presenting the Products placed on the Store's website are for illustrative purposes only and may not fully reflect the actual appearance of the Product or show all its details. The Store is not responsible for differences in the appearance or color of the ordered Products, which result from technical reasons or related to different mapping of colors and materials (structure, density) of the Products on computers or other Users' media.
    6. The Store may offer promotions, discounts and other forms of temporary modification of the terms of sale specified in the Regulations, which are beneficial to the Customer. Information about the offered promotions, discounts and other modifications of the terms of sale are visible on the Store's website. Such provisions take precedence over the provisions of the Regulations. The decisive moment for the conditions of the Product Sale is the moment of placing the Order by the Customer.
    7. The terms of sale of Products in the Store apply only to purchases made via the Online Store Laura Guidi sp. zoo Sp. komandytowa, and may differ from the terms of sale of Products in the network of Laura Guidi sp. zoo Sp. komandytowa, . Promotions and discounts valid in the network of Laura Guidi sp. zoo Sp. komandytowa, do not apply to purchases made in the online store Laura Guidi sp. zoo Sp. komandytowa, unless otherwise stated.
    8. Price lists or advertisements placed in the Store constitute commercial information and an invitation to conclude a Sales Agreement, but do not constitute an offer within the meaning of the provisions of the Civil Code.
  4. Product prices
    1. All prices of the Products indicated in the Store are expressed in Polish zlotys and are gross prices (including VAT).
    2. The price given for the Product is binding at the time of placing the Order by the User and is not negotiable. The final price (the price of the entire Order together with any discounts) is each time confirmed to the Customer at the time of confirming the Order before sending it. The indicated price is also confirmed on the sales document sent with the goods (receipt or VAT invoice).
    3. The Store reserves the right to change the prices of the Products on the Store's website and to make other changes to the presented range of Products. These changes do not infringe the rights of persons who have concluded a Sales Agreement for Products presented for sale by the Store before making the changes.
  5. Receipt and execution of the order
    1. The Sales Agreement is concluded upon confirmation of the Order by the Store, sent to the e-mail address provided by the User. At this moment, the User becomes a Customer of the Store.
    2. The Store starts processing the Order immediately after the User has credited the payment to the Seller's account or confirmed by the website providing intermediary services in making payments via the Internet that the payment has been made.
    3. With regard to Orders paid in advance (prepayment), if the payment is not credited to the Seller's account within 7 days from the date of placing the Order or in the event that the website providing intermediation services in making payments via the Internet does not confirm within 7 days from the date of after submitting the Order that the payment has been made, the Order is canceled, about which the User will be informed by the Store.
    4. The Seller reserves the right to withdraw from the execution of the Order due to the inability to fulfill the Order placed, if the data provided by the Customer is incomplete, incorrect or raise reasonable doubts as to their accuracy. The Seller shall notify the Customer of each withdrawal from the execution of the Order with an indication of the reason.
    5. All Products presented on the Store's website are available Products, unless otherwise stated on the Store's website. However, in exceptional situations (e.g. when several Customers place an order for the same Product at the same time), the Product may be unavailable. In this case, the Seller has the right to withdraw from the contract, about which the Customer will be informed immediately, no later than 3 days from the date of placing the Order, and the payment made will be returned to him.
    6. In the event of unavailability of some of the Products covered by the Order and the impossibility of executing the Order in this part within 3 days, the Customer will be informed by the Store staff about the status of the Order and decide to either partially implement the placed Order or cancel the entire Order.
    7. The number of Products intended for promotional sales and sales is limited. Orders for Products of this type are processed in the order in which confirmed Orders are received, until the stocks covered by this form of sale are exhausted. The Store informs the Customer about the exhaustion of the Products covered by the promotional sale or sale, pursuant to point 6.5. of the Regulations.
    8. The Store reserves the right to refuse to process the Order in a situation where the history of cooperation undermines the credibility and reliability of the Customer.
  6. Order delivery
    1. The delivery of the Products takes place via the Supplier indicated by the User in the Order or by personal collection at a selected Laura Guidi sp. zoo Sp. komandytowa, . The delivery time is determined in accordance with the delivery dates declared by the carriers.
    2. The order is transferred to the Supplier within 5 working days from the moment of placing the Order, but not earlier than before the payment is credited to the Seller's account or before the website providing intermediation services in making payments via the Internet confirms that the payment has been made - in relation to orders paid in advance (prepayment). Together with the Order, the Customer receives information regarding the concluded Sales Agreement, the place and method of submitting a complaint and the right to terminate the contract.
    3. It is recommended to check, in the presence of the Supplier's representative, the completeness of the content of the Order, the condition of the outer packaging and the condition of the ordered Product when collecting the delivered shipment. In the case of noticed irregularities, a damage report signed by the Customer or his representative and the Supplier's representative should be drawn up together with the Supplier's representative and the Store should be notified.
    4. The information provided by the Customer, enabling the execution of the Order, should be true, up-to-date, complete and accurate. Otherwise, the Store is unable to deliver the placed Order and is not responsible for its failure.
    5. If the Store specifies the time within which the Customer will receive the Order, the Order covering Products with different delivery times is sent when the entire Order is completed, and the Order completion date is determined on the basis of the Product with the longest order completion time.
    6. Delivery is attempted twice. After an unsuccessful delivery attempt, the Product will be returned to the Laura Guidi sp. zoo Sp. komandytowa, of which the Customer will be notified by sending correspondence to the e-mail address provided in the Order. In the case of Products for which the Customer has declared payment on delivery, after the second unsuccessful attempt to deliver the shipment, the order placed by the Customer is automatically canceled.
  7. Product Returns and Exchanges
    1. The User (Customer) who is a Consumer has the right to withdraw from the Sales Agreement without giving a reason within 14 days from the date of delivery of the Order, in accordance with the provisions of the Act on the protection of certain consumer rights and liability for damage caused by a dangerous product. The right to withdraw from the Sales Agreement referred to in this point of the Regulations does not apply to Sales Agreements concluded with Entrepreneurs.
    2. Withdrawal from the Sales Agreement takes place in writing, on the basis of a completed and signed by the Customer return form. The signed form should be delivered to the Seller together with the returned Product and the accounting proof of purchase (receipt or VAT invoice) to the address indicated in point 1.3. of the Regulations, within 14 days from the date of receipt of the Order.
    3. Withdrawal from the Sales Agreement is possible if the Product is returned undamaged by mechanical factors and without signs of use. The return of the Product is at the Customer's expense. It is recommended to properly secure the returned Product.
    4. In the event of withdrawal from the Sales Agreement, the Store will return the price paid for the Product to the Customer, no later than within 14 days from the date of delivery to the Store of the returned Product and the declaration of withdrawal from the Sales Agreement, by transfer to the bank account from which the Order was paid, or to another indicated by the customer's bank account.
    5. The right to withdraw from the Sales Agreement is not entitled to the Consumer in the case of services with properties specified individually by the Consumer in the Order placed by him or closely related to his person (in accordance with Article 10 paragraph 3 point 4 of the Act on the protection of certain consumer rights and liability for damage caused by a dangerous product).
    6. The Customer has the right to exchange the Product for another Product presented for sale in the Store. The right to exchange applies to a complete Product, with tags and no signs of use. To exchange, please complete exchange form. The signed original of the exchange form should be sent together with the replaced Product and the accounting proof of purchase (receipt or invoice) to the address indicated in point 1.3. of the Regulations.
    7. Online store Laura Guidi sp. zoo Sp. komandytowa, does not accept parcels sent on delivery or to a parcel locker.
  8. Product Complaints
    1. The complaint of the Product may be made due to the non-compliance of the Product with the Sales Agreement, on the terms set out in the Act on special conditions of consumer sales and amendments to the Civil Code.
    2. The claimed Product belongs together with the filled one complaint formand accounting proof of purchase (receipt or VAT invoice) to be sent to the address indicated in point 1.3. of the Regulations. The delivery costs related to returning the Product under complaint will be reimbursed if the complaint is accepted. All returns and shipments sent at the expense of Laura Guidi sp. zoo Sp. komanditowa, z oo will not be accepted, unless other written arrangements have been made.
    3. The Customer loses the right to complain about the Product if, within two months from the discovery of non-compliance of the Product with the Sales Agreement, he does not notify the Store about it. To meet this deadline, it is enough to send a notification to the Store's e-mail address before its expiry.
    4. Complaints are considered at the latest within 14 days from the date of receipt by the Store of the shipment with the Product under complaint.
    5. If the complaint is accepted, the Product will be, in accordance with the Customer's will, first repaired or replaced with another, full-fledged one. If this is impossible or requires excessive costs, the Store will return the equivalent of the Product price to the Customer.
    6. If the replacement of the Product would expose the Customer to significant inconvenience, he has the right to demand an appropriate price reduction or withdraw from the Sales Agreement, unless the non-compliance of the Product with the Sales Agreement is irrelevant. At the Customer's request, it is also possible, instead of obtaining a refund of the price paid, to exchange the Product under complaint for another Product available in the Store. In this case, the delivery of the Product will be at the Customer's expense, and the Customer will only receive a refund of the price difference (if the purchased Product is of lesser value than the advertised Product) or will be obliged to pay the difference (if the purchased Product is of greater value than the advertised Product).
    7. If the complaint is not considered, the Product will be sent back to the Customer along with an opinion on the unjustification of the complaint.
  9. newsletter
    1. The user has the option of ordering the Laura Guidi sp. zoo Sp. komanditowa, sending information in the form of a Newsletter to the e-mail address provided by you. By placing an order to send the Newsletter, the User also ensures that he is authorized to have the e-mail address to which the information is to be sent.
    2. By expressing consent, the User declares that he acknowledges that the order to send the Newsletter by the Store is voluntary, however, the lack of such an order may be tantamount to the inability to participate in marked promotional programs or use other optional benefits and the inability of the Store to inform the User about new products.
    3. The Customer may unsubscribe from the Newsletter at any time.
  10. Final Provisions
    1. The Regulations come into force on the day of its announcement on the website of the Online Store Laura Guidi sp. zoo Sp. komandytowa, .
    2. The Seller reserves the right to change the Regulations at any time. The User will be notified of changes to the Regulations by placing an appropriate message on the Store's website and through the information visible in his Account. The change becomes effective on the date indicated by the Seller. The amendment to the Regulations is not retroactive and does not affect the rights of persons acquired under the Regulations in the previous wording.
    3. The current Regulations are posted on the website of the Laura Guidi sp. zoo Sp. komanditowa, and made available free of charge to the User at his every request.
    4. The Store and in particular its name, concept, graphic design, database, copyrights to works on the Store's website and industrial property rights, including trademark protection rights, is the property of Laura Guidi sp. zoo Sp. komandytowa, z o. o. or entities with which Laura Guidi sp. zoo Sp. komandytowa, Sp. z o. o. has entered into relevant agreements and is subject to legal protection.
    5. To the extent not regulated in the Regulations, generally applicable provisions of law shall apply, in particular the standards of the Civil Code, the Act on the protection of certain consumer rights and on liability for damage caused by a dangerous product, the Act on special conditions of consumer sales and amending the Civil Code, the Act on data protection personal data and the Act on the provision of electronic services.
    6. The law applicable to the Regulations is Polish law, and any disputes related to the use of the Store will be settled by the Polish common courts of competent jurisdiction.
    7. Additional information on the operation of the online store Laura Guidi sp. zoo Sp. komanditowa, and the status of the Order can be obtained at the address indicated in point 1.3 of the Regulations.
